Terms of Service

1. Agreement to Terms

By accessing or using Forestry.md ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Forestry.md is a web publishing platform that allows users to publish content from Obsidian vaults to the internet. The Service includes hosting, build infrastructure, domain management, and preview functionality.

4. User Accounts

To use the Service, you must:

• Be at least 13 years of age
• Provide accurate registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use

You are responsible for all activity under your account.

5. Subscription and Payment

Billing

• Fees are billed in advance on a monthly or annual basis
• All fees are in US Dollars (USD)
• Applicable taxes (including VAT) will be added based on your location
• Payment is processed through Stripe

Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings.

Refunds and Right of Withdrawal

In accordance with EU consumer protection law, you have the right to withdraw from your purchase within 14 days without giving any reason. To exercise this right, contact us at support@forestry.md.

If you have actively used the Service during the withdrawal period, we may deduct a proportionate amount for the service already provided.

Price Changes

We may modify pricing with at least 30 days notice. Changes take effect at the next billing cycle.

6. Acceptable Use

Prohibited Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Engage in phishing, spam, or fraud
• Host content promoting violence, hatred, or discrimination
• Host sexually explicit content involving minors
• Interfere with or disrupt the Service
• Attempt unauthorized access to any part of the Service
• Mine cryptocurrency
• Resell the Service without authorization
• Circumvent usage limits

Enforcement

We may suspend or terminate accounts that violate these Terms, with or without notice.

7. Intellectual Property

Our Property

The Service, including its original content, features, and functionality, is owned by Forestry.md and protected by intellectual property laws.

Your Content

You retain all rights to content you publish ("User Content"). You grant us a limited license to host and distribute your content solely to provide the Service.

8. User Content and Data

Ownership

You own your User Content. We do not claim ownership rights over your content.

Backups

You are responsible for maintaining your own backups. Your Obsidian vault serves as your primary backup.

Content Removal

Upon account termination:

• Your published sites will be taken offline
• Your data will be deleted within 30 days
• Some data may persist in backups for up to 90 days

9. Third-Party Services

The Service uses third-party providers:

• GitHub (US): Source file storage
• Microsoft Azure (EU/US): Build infrastructure
• DigitalOcean (EU/US): Website hosting
• Supabase (EU): Authentication, database
• Stripe (US): Payment processing

By using the Service, you acknowledge your data may be processed by these providers.

10. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or infrastructure outages, third-party service provider failures, cyberattacks, or other events outside our control.

12. Service Availability and Warranties

We strive to provide a reliable service but cannot guarantee uninterrupted availability. The Service is provided "as is" and "as available".

We make no warranties, express or implied, regarding:

• Uninterrupted or error-free operation
• Accuracy or reliability of results
• Fitness for any particular purpose

These limitations do not affect your statutory rights as a consumer under Norwegian or EU law, which cannot be excluded or limited by contract.

13. Limitation of Liability

To the extent permitted by applicable law, Forestry.md shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss

Our total liability for any claim shall not exceed the greater of:

• The amount you paid us in the 12 months preceding the claim, or
• One hundred US Dollars ($100)

Nothing in these Terms limits our liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Forestry.md from any claims, damages, or expenses arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of third-party rights

15. Termination

By You

You may terminate your account at any time through account settings.

By Us

We may terminate your account immediately for:

• Breach of these Terms
• Non-payment
• Harmful conduct

Effect

Upon termination, your right to use the Service ceases and your sites will be taken offline.

16. Dispute Resolution

Governing Law

These Terms are governed by the laws of Norway.

Jurisdiction

Legal action shall be brought exclusively in Norwegian courts. If you are a consumer residing in the EU, you may also bring proceedings in the courts of your country of residence.

Consumer Disputes

If you are a consumer and we cannot resolve a dispute, you may refer the matter to the Norwegian Consumer Council (Forbrukerrådet) or use the EU Online Dispute Resolution platform at https://ec.europa.eu/odr.

17. Changes to Terms

We may modify these Terms with at least 30 days notice for material changes. Continued use after changes take effect constitutes acceptance.

18. General

• These Terms constitute the entire agreement between you and Forestry.md
• If any provision is unenforceable, remaining provisions continue in effect
• Our failure to enforce any right is not a waiver
• You may not assign your rights without our consent
